("Cubby," “GetCubby”, "we," "us," "our") provides its services to you through its mobile applications (“App”), website located at https://getcubby.com (the "Site") and through related services (collectively, such services, including any new features and applications, and the Site, the "Service(s)"),

 

We are committed to protecting your privacy and ensuring the security of your personal information. This Privacy Policy outlines how we collect, use, and safeguard your data when you use our Service

 

By downloading, accessing, or using the Service, you consent to the practices described in this Privacy Policy. Please take the time to read this policy carefully.


1. INFORMATION WE COLLECT

The categories of information we collect depend on how you interact with us, the Service, and the requirements of applicable law. For example, we may collect different information from you depending on whether you are a visitor to our website or register to use the Service.

 

  • Personal information‍. “Personal Information” means information that can be used to identify you, as further described below. Your submission of Personal Information is voluntary, but we may be unable to provide you requested information or services if you choose not to provide necessary Personal Information. We or our representatives may collect the following categories of Personal Information:

i. Identifiers - A real name, alias, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, account name, or other similar identifiers

ii. Categories listed in the California Customer Records law (Cal. Civ. Code §1798.80 (e)) - A name, signature, Social Security number, physical Yes characteristics or description, address, telephone, number, passport number, driver's license or state identification card number, insurance policy number, education, employment status, employment history, bank account number, credit card number, debit card number, or any other financial information, medical information, or health insurance information.

iii. Protected classification characteristics under California or federal law - Age (40 years or older), race, color, ancestry, national origin, citizenship, religion or creed, marital status, medical condition, physical or mental disability, sex(including gender, gender identity, gender expression, pregnancy or childbirth and related medical conditions), sexual orientation, veteran or military status, genetic information (including familial genetic information).

iv. Commercial information - Records of products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.

v. Internet or other similar network activity - Browsing history, search history, information on a consumer's interaction with our website, application, or advertisement.

vi. Geolocation data - Physical location or movements.

vii. Sensory data - Audio, electronic, visual, thermal, olfactory, or similar information.

 

  • Sensitive Personal Information. We may collect Personal Information that is considered “sensitive” in some jurisdictions to the extent you create such information by using our application, or to the extent you share it with us. You are not required to provide sensitive information to use our application. However, if you provide it, it will be used in accordance with this policy.

  • Non-Personal Information. We also collect “Non-Personal Information,” meaning technical and other information that does not identify you personally. Non-Personal Information also includes information that may originally have been Personal Information but has been aggregated or anonymized such that it cannot be used to identify any individual or has been segregated from other Personal Information.


2. SOURCES OF PERSONAL INFORMATION COLLECTION
  • When you register for and use the Service. When you register for the Service, we typically collect fields such as your first name, last name, email address, postal address, telephone number, birthdate, profile picture, and demographic information(e.g., gender). We also collect information about actions inputted into the Services, such as email messages you may be included in or events that you partake in, which may include Personal Information.

  • Your communications with us. We may collect your name, email address, postal address, and telephone number when you request information about our Services, register for email alerts, request customer or technical support, or otherwise communicate with us. When applying for a job, we may collect resumes, cover letters, and similar materials.

  • Surveys/Questionnaires/Your Content. We may contact you to participate in surveys or other questionnaires or the Services may offer you the opportunity to create original content which can be shared with other users (“Content”). If you decide to participate, you may be asked to provide certain information, which may includePersonal Information.

  • Third-Party Providers. The Service may give you the option to link your accounts on third-party platforms or use those platforms via our Services (e.g., email, calendar and scheduling services) (collectively, “Third-Party Providers”) and we may import relevant Personal Information from those Third-Party Providers. This linking is entirely optional and subject to the consent you provide to either us or to the Third Party, but may enable a richer and more effective user experience. If you do link such accounts, you acknowledge and agree that we, via the Services, will receive Personal Information from such Third-Party Providers.

  • Automatic Data Collection. We, or our third-party partners, may collect personal information and de-identified information automatically when you use our Services. This may include your Internet protocol (IP) address, user settings, device identification number, actions taken on the Services, anonymized messages, browser or device information, and Internet service provider, for purposes such as analytics, machine-learning, security, and otherwise providing more streamlined/optimized, personalized, or relevant features and functionality on the Services. 

  • Collection Methods. Information is collected via various technologies, including server logs, mobile SDKs, pixels or cookies on our websites. These collection methods may be provided by us or our third-party partners (e.g.,Google Analytics, Amplitude). Cookies are identifiers that we transfer to your device to enable our system to recognize you and your personalized settings, to better understand how you interact with the Service, to monitor aggregate usage, and to optimize web traffic routing on our website. You may be able to disable or limit the use of cookies in your browser or device settings, but please note that certain parts or features of the Services may not be fully functional if you do so.


3. USAGE OF INFORMATION

We use your information to provide the Service and improve your experience. This is necessary to ensure the delivery of the Service. 

 

  • Service Delivery. We use your Personal Information to provide you with our Services. This includes but is not limited to: 

i. Managing your accounts and user content posted to the Service.

ii. Providing access to certain areas, functionalities, and features of our Services

iii. To update and synchronize Service features and content across multiple devices (ie so that you and your spouse see the same information)

iv. Responding to your inquiries and requests for customer support

v. To manage our relationship with you, which includes sending administrative information to you relating to our Service and changes to our terms, conditions, and policies and sending account verification or technical/security notices;

 

  • Legitimate Business Interests. We use your Personal Information for various other legitimate business purposes, such as:

i. Improving and enhancing the Service, including through machine learning and automation such as learning which messages are worthy of a notification.

ii. To comply with legal obligations and legal process and to protect our rights, privacy, safety or property, and/or that of our affiliates, you or other third parties, and recover debts due to us.

iii. Perform customer research and measuring engagement in the Service.

iv. To prevent each or all of the following: fraud, criminal activity, misuses of our site, or violations of our Terms of Service

v. Ensure the security of our IT systems, architecture and networks.

  • Aggregated Information. We may aggregate Personal Information and use the aggregated information to analyze the effectiveness of our Service, to improve and add features to our Service, and for other similar purposes. In addition, from time to time, we may analyze the general behavior and characteristics of users of our Services. We may collect aggregated information through the Service, through cookies, and through other means described in this Privacy Policy.


4. DISCLOSING PERSONAL INFORMATION

In certain circumstances we may share your Personal Data with third parties without further notice to you, unless required by the law, as set forth below:

  • Vendors and Service Providers: To assist us in meeting business operations needs and to perform certain services and functions, we may share Personal Information with service providers, including web hosting, debugging services, email and productivity services, survey providers, database and sales/customer relationship management services, customer service providers, payment processors; web and app analytics services, and data brokers. 

  • Business Transfers: If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of all or a portion of our assets, or transition of service to another provider, your Personal Data and other information may be shared in the diligence process with counterparties and others assisting with the transaction and transferred to a successor or affiliate as part of that transaction along with other assets.

  • Legal Requirements: If required to do so by law or in the good faith belief that such action is necessary to (i) comply with legal or regulatory obligations, (ii) protect and defend our rights or property, (iii) prevent fraud, (iv) act in urgent circumstances to protect the personal safety of users of the Site, or the public, or (v) protect against legal liability.

  • We may also share your Personal Information to other parties at your request, where permitted by law, or any manner you have otherwise consented to.

We keep Personal Information for as long as reasonably necessary for the purposes described in this Privacy Policy, while we have a legitimate business need to do so, or as required by law (e.g. for tax, legal, accounting or other purposes), whichever is the longer.

 

If you have elected to receive marketing communications from us, we retain information about your marketing preferences until you opt out of receiving these communications and in accordance with our policies.

 

To determine the appropriate retention period for your Personal Information, we will consider the amount, nature, and sensitivity of the Personal Information, the potential risk of harm from unauthorized use or disclosure of your Personal Information, the purposes for which we use your Personal Information and whether we can achieve those purposes through other means, and the applicable legal requirements.


6. SECURITY OF YOUR INFORMATION

We have implemented and maintain physical, technical, and administrative security measures designed to protect Personal Information from unauthorized access, destruction, use, modification, or disclosure. Unfortunately, no system is 100% secure, and we cannot ensure or warrant the security of any information you provide to us. To the fullest extent permitted by applicable law, we do not accept liability for unauthorized disclosure.

 

By using our Services or providing Personal Information to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of our Services.


7. YOUR CALIFORNIA PRIVACY RIGHTS
  • Online Tracking and Do Not Track Signals. We may allow third party service providers to use cookies or other tracking technologies to collect information about your browsing activities over time and across different websites following your use of the Site. Our Site currently does not respond to "Do Not Track" ("DNT") signals and operates as described in this Privacy Policy whether or not a DNT signal is received. If we do respond to DNT signals in the future, we will describe how we do so in this Privacy Policy.

  • Data Requests. Email support@getcubby.com to request and receive information regarding the Personal Information we have collected in the past 12 months. 

  • We will not discriminate anyone that chooses to exercise any of these rights.


‍8. INTERNATIONAL DATA TRANSFERS

All information processed by us may be processed and stored anywhere in the world, including, but not limited to, the United States or other countries, which may have data protection laws that are different from the laws where you live. If you use our services, you consent to the transfer of your information from any country to any other country.


‍9. CHILDREN’S INFORMATION

The Service is not directed to children under 13. If you are a parent or guardian and believe that your child has provided personal information to us without your consent, you may contact support@getcubby.com and we will endeavor to delete that information from our databases. If we become aware that a child has provided us with personal information in violation of applicable law, we will delete any personal information we have collected, unless we have a legal obligation to keep it.


10. LINKS TO OTHER WEBSITES

The Service may contain links to other websites not operated or controlled by GetCubby, including social media services ("Third Party Sites"). The information that you share with Third Party Sites will be governed by the specific privacy policies and terms of service of the Third Party Sites and not by this Privacy Policy. By providing these links we do not imply that we endorse or have reviewed these sites. Please contact the Third Party Sites directly for information on their privacy practices and policies.


11. DISCLAIMER

You use the Service at your own risk. We comply with industry standards to protect Personal Information both online and offline from loss, misuse, and unauthorized access, disclosure, alteration or destruction. However, no Internet or e-mail transmission is ever fully secure or error free. Therefore, you should take special care in deciding what information you send to us via the Service. Please keep this in mind when disclosing any Personal Information to GetCubby via the Internet. In addition, we are not responsible for circumvention of any privacy settings or security measures contained on the Service, or third party websites.


12. CHANGES TO PRIVACY POLICY

The Service, and our business may change from time to time. As a result we may change this Privacy Policy at any time. When we do we will post an updated version on this page, unless another type of notice is required by the applicable law. By continuing to use our Service or providing us with Personal Data after we have posted an updated Privacy Policy, or notified you if applicable, you consent to the revised Privacy Policy and practices described in it.
